The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Proviso to the residential dwelling entry in Notification No. 13/2017-Central Tax (Rate), inserted by Notification No. 15/2022-Central Tax (Rate) dated 30.12.2022 with effect from 1 January 2023 · 2022-12-30

The residential rent reverse charge as first drafted caught every registered person, including a proprietor who held a GST number for his trading business but was simply renting a house for his family. A proviso was inserted to say that the reverse charge does not apply where the dwelling is rented to a registered person who is a proprietor of a proprietorship concern and rents it in his personal capacity as his own residence, on his own account. The relief operates from 1 January 2023.

Practical effect: A Chennai proprietor renting his own family home need not pay GST on the rent, but should keep the lease deed in his personal name to prove the point.

If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
The audit team has pointed out a tax liability. Should I pay it or contest it?
Evaluate each para on its own merits. For findings that are clearly correct, such as missed reverse charge or arithmetic ITC excess, paying through DRC-03 with interest before a show cause notice is issued avoids penalty under Section 73 and closes the para. For findings based on debatable classification, valuation or ITC interpretation, submit a reasoned rebuttal to the draft observations, because accepting them sets a precedent for future years. If the department still proceeds, contest the DRC-01 through DRC-06 and, if needed, appeal.
