It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

Money parked in the cash ledger does not stop interest until the return is filed

RSB Transmissions (India) Ltd v. Union of India — Jharkhand High Court, judgment dated 18 October 2022 · 2022-10-18

The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

What it means for you: Depositing cash into the ledger early does not protect you from interest — the GSTR-3B must actually be filed on time.

After representations the implementation was deferred by three months. The idea returned later as a thirty day reporting limit applying to taxpayers with turnover of ten crore rupees and above.

We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Since 1 January 2019, security services by way of supply of security personnel provided by any person other than a body corporate to a registered person fall under reverse charge, so your business pays the 18 percent directly and claims credit. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. No. For taxpayers with aggregate turnover up to Rs.2 crore, filing GSTR-9 has been made optional through CBIC notifications, and this relaxation has been continued year on year. If you do not file by the due date, the return is deemed furnished. My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends.
