Notification No. 8/2018-Central Tax (Rate), dated 25 January 2018 · 2018-01-25
This notification gave second-hand vehicle dealers a concessional rate charged not on the sale price but on the margin, that is the difference between the selling price and the purchase price, or the depreciated value where depreciation was claimed under the Income-tax Act. The concession applied only if the supplier had not availed input tax credit on the vehicle, and where the margin is negative no GST is payable. Compensation cess on such vehicles was separately exempted.
What to do about it: A used-car dealer in Chennai pays GST only on the mark-up, so accurate purchase and sale records for each vehicle are the whole defence in an audit.
Circular No. 139/09/2020-GST dated 10 June 2020 · 2020-06-10
Circular 135/05/2020 had restricted refund of accumulated input tax credit to invoices reflected in FORM GSTR-2A, which caused difficulty because credit on imports, on invoices issued by an input service distributor and on supplies liable to reverse charge never appears there. CBIC clarified that the restriction was never intended to cover those categories, and that refund of credit availed on such documents continues to be allowed on the strength of the documents themselves.
What to do about it: Importers and firms paying reverse charge in Chennai should quote this circular if a refund officer disallows credit merely because it is absent from GSTR-2A.
Easwaran Brothers India (P) Ltd v. Assistant Commissioner (ST) (FAC) — Madras High Court, 2022 · 2022-12-15
In the context of transition from TNVAT to GST, a dealer with excess input tax credit sought refund, while the department insisted the credit ought to have been carried forward. The Madras High Court held that refund and carry-forward are two distinct options available to the dealer, and the choice belongs to the taxpayer; the department cannot force a dealer to transition credit and thereby defeat a legitimate refund claim that was otherwise in order.
What to do about it: Where the law gives you an option between refund and credit carry-forward, exercise it in writing and hold the department to it — the choice is yours, not the officer's.
