The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.
Why this matters: Chennai group companies giving guarantees to each other should review the current GST valuation rule, since the earlier no-consideration argument no longer holds under GST.

CBIC notified 'Account Aggregator', as defined under the RBI's NBFC-Account Aggregator directions, as a system with which the GST common portal may share taxpayer information under Section 158A.
