The Supreme Court held that where an appeal is barred by limitation and the appellate authority has no power to condone the delay, a High Court should not exercise writ jurisdiction merely to grant the same relief. Doing so would defeat the legislative scheme of limitation. Writ jurisdiction is not to be used as a substitute for a statutory remedy that the taxpayer allowed to lapse.

What to do about it: Chennai taxpayers should not assume the High Court will rescue a GST appeal filed beyond the condonable period, so deadlines must be diarised.

This companion notification exempted intra-State supplies of listed goods from central tax altogether, covering fresh vegetables and fruit, unbranded cereals and pulses, milk, curd, salt, live animals, human blood, printed books, judicial stamp paper and many agricultural items. Suppliers dealing only in these goods make exempt supplies, cannot claim input tax credit on related purchases, and must reverse credit under Rule 42 where inputs are common. It was superseded with effect from 22 September 2025.

Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. Can I use my input tax credit balance to pay a DRC-03 liability?

If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
We sponsored a trade event. Does reverse charge apply to the sponsorship amount?
If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day.
