CBIC clarified that where a manufacturer replaces parts or provides repair services free of cost during the warranty period, no further GST is payable because the value of the warranty was already included in the price of the original supply on which tax was paid. Consequently the manufacturer need not reverse input tax credit on such replacement parts. Where a distributor replaces parts from his own stock and is reimbursed through a credit note, the position was explained separately.
Why this matters: Manufacturers and dealers should not pay GST again on warranty replacements, and should resist ITC reversal demands raised on free-of-cost warranty issues.

The Supreme Court held that credit validly earned on inputs already received and used becomes a vested right of the manufacturer. A rule that sought to lapse such accumulated credit was struck down as it operated to take away a right that had already accrued, without any corresponding change in the underlying transaction. Rights that have crystallised cannot be extinguished by a subsequent rule operating retrospectively.
Why this matters: Where a Chennai business has validly earned input tax credit, it can resist any attempt to lapse that credit through a later procedural change.
GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025.
