Circular No. 123/42/2019-GST dated 11 November 2019 · 2019-11-11

CBIC explained the newly inserted rule 36(4). The restriction is not supplier-wise but is computed on a consolidated basis for all invoices not appearing in GSTR-2A. The amount of eligible credit is determined from GSTR-2A as on the due date for filing GSTR-1 by suppliers for that month. A taxpayer may therefore claim only twenty per cent more than the credit reflected in GSTR-2A, and the balance may be claimed in a later month once the supplier uploads the invoice.

Mandatory HSN reporting in Table 12 of GSTR-1 was introduced in phases from 1 April 2022, when the portal began flagging missing or short codes in warning mode. In Phase-II, from the November 2022 return period, taxpayers with annual aggregate turnover up to Rs 5 crore had to report at least four-digit HSN codes for all business-to-business supplies in Table 12, and taxpayers above Rs 5 crore had to report six digits for all supplies. Phase-III in 2025 went further and replaced manual entry with selection from a dropdown of valid codes.

What to do about it: Correct HSN codes once at the item-master level, so that each successive tightening of portal validation does not force fresh rework.

Do I have to report HSN codes in my GSTR-1?
Yes. Taxpayers with aggregate turnover up to Rs.5 crore must report a 4-digit HSN summary for B2B supplies in Table 12 of GSTR-1, while those above Rs.5 crore must report 6-digit HSN codes for all supplies. The portal now validates HSN entries against its master list, so wrong or truncated codes can block filing. In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. Credits discovered after this date are permanently lost, which is why a year-end reconciliation in September or October, comparing books, GSTR-2B and GSTR-3B for the full year, is essential for every business in Ayanavaram.
My supplier has not uploaded an invoice and it is missing from GSTR-2B. Can I still claim the ITC?
No, not until it appears. My staff stay in hotels in other states on tour. Why can I not claim that GST?
Because of the place of supply rule. Hotel accommodation is taxed where the hotel is located, so a Mumbai hotel charges CGST plus Maharashtra SGST even when the guest's employer is registered in Tamil Nadu. Your Tamil Nadu GSTIN can utilise only IGST, CGST and Tamil Nadu SGST, so another state's CGST and SGST is unusable credit; it will appear in your GSTR-2B but must be excluded from the claim. Options are limited: absorb it as cost, or obtain registration in states with heavy recurring stays, which rarely pays. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider.
