The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.

46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31
The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.
What to do about it: Textile traders in Chennai and across Tamil Nadu continued at five per cent from January 2022, but footwear moved to twelve per cent, so the two sectors diverged from that date.

Acting on the 47th GST Council recommendation, this notification rewrote the goods schedule so that curd, lassi, buttermilk, paneer, honey, cereals, pulses, flour, jaggery, puffed rice and similar staples attract five per cent when they are pre-packaged and labelled. The earlier test of whether the goods carried a registered brand name was abandoned, because it had been widely defeated by suppliers voluntarily forgoing brand registration. The change took effect from 18 July 2022.
What to do about it: From July 2022 a Chennai rice or flour dealer selling in labelled retail packs charges five per cent even if the pack carries no registered brand.
