The Council approved the draft SGST law and the draft UTGST law, completing the legislative package begun at the previous meeting, and also approved amendments to the GST (Compensation to States) Bill including the ceiling rates at which compensation cess could be imposed. GSTN Advisory dated 23 August 2024 — Rule 10A bank account furnishing · 2024-08-23
GSTN advised that under Rule 10A of the CGST Rules, registered taxpayers must furnish valid bank account details within 30 days of registration or before filing GSTR-1 or IFF, whichever is earlier. From 1 September 2024 the portal blocks GSTR-1 and IFF filing for taxpayers whose bank account details are not available and validated on the portal. The measure targets fraudulent registrations created without genuine banking trails.
What it means for you: Newly registered businesses should add and validate their bank account on the portal immediately after registration to avoid a filing blockage.
Thai Mookambikaa Ladies Hostel v. Union of India — Madras High Court, W.P. No. 28486 of 2023, judgment dated 22 March 2024 (reversing the Tamil Nadu AAR) · 2024-03-22
The Tamil Nadu AAR held that hostel accommodation provided to college students and working women is not renting of a residential dwelling for use as residence, so the exemption did not apply and GST was payable. On writ, the Madras High Court reversed that view on 22 March 2024, holding that hostel rooms occupied by girl students and working women as their residence qualify for the exemption for renting of residential dwelling under Entry 12 of Notification No. 12/2017-Central Tax (Rate), and observing that the legislature never intended to burden such occupants with tax.
