Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.

At what amount of tax evasion can GST prosecution be launched?

You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
