Premier Sales Promotion (P) Ltd v. Union of India — Karnataka High Court, 2023 · 2023-01-16

A company procuring and supplying prepaid vouchers, gift cards and e-vouchers to corporate clients was held liable to GST by the AAR and AAAR. The Karnataka High Court reversed, holding that vouchers are in the nature of pre-deposit instruments or actionable claims — a means of payment for future supplies — and their mere trading is neither a supply of goods nor of services, so no GST is payable on the voucher itself. CBIC later clarified voucher taxation consistently with this position.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.

Can I revise GSTR-9 after filing if I find an error?

Why should I reconcile GSTR-2B with my purchase books every month?
Because your input tax credit in GSTR-3B is legally restricted to invoices appearing in GSTR-2B. Do I get ITC on machinery purchase in one shot or in instalments over years?
In one shot. Unlike the old VAT regime, GST allows the entire input tax credit on capital goods in the month of receipt, provided the machinery is used for taxable supplies and the invoice appears in your GSTR-2B. The one critical condition sits in Section 16(3): if you claim income tax depreciation on the GST component of the asset's cost, the credit is denied. The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct.
