The taxpayer argued that once the state authorities had initiated proceedings, the central authority could not summon it under Section 70. The High Court held that the bar in Section 6(2)(b) applies to proceedings on the same subject matter, meaning assessment or adjudication, and that the scope of Section 70 is different and distinct. An inquiry conducted by way of summons to gather information is therefore not barred merely because another authority has already initiated proceedings.

Practical effect: A summons from a second GST wing is not automatically illegal; the stronger objection arises only when the second wing begins adjudicating the same issue.
