If you are GST-registered and the foreign supplier has not charged Indian GST, yes. Services received from a supplier located outside India for business purposes are an import of services, taxable in your hands under reverse charge at 18 percent. You must pay the tax in cash through GSTR-3B, raise a self-invoice, and can simultaneously claim the same amount as input tax credit if the expense is otherwise eligible, making it cash-flow neutral for most businesses. I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
My GST status shows suspended. What does that mean for my business in Chintadripet?

What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Chintadripet manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu.
