CBIC explained the relief notified through Notifications 30 to 36 of 2020-Central Tax after the first lockdown. It set out, return by return and class by class, the extended dates for GSTR-3B and GSTR-1, the conditional waiver of interest for the tax periods February to April 2020 with nil interest for the first fifteen days and nine per cent thereafter for larger taxpayers, the waiver of late fee, the relaxation of the rule 36(4) credit restriction, and the extension for composition taxpayers.

Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.

Notification No. 17/2024-Central Tax · 2024-09-27
CBIC appointed 27 September 2024 as the commencement date for the first tranche of Finance (No. 2) Act, 2024 GST amendments, including Section 118 of that Act which inserted Sections 16(5) and 16(6) of the CGST Act. Those provisions retrospectively allow input tax credit for FY 2017-18 to 2020-21 if claimed in any GSTR-3B filed up to 30 November 2021, and restore credit where returns were filed after revocation of cancellation. The bulk of the remaining amendments, including the Section 128A interest and penalty waiver scheme, were brought into force from 1 November 2024.
Why this matters: Demands built purely on the old Section 16(4) time limit for 2017-18 to 2020-21 became legally unsustainable from this date, so contest or seek rectification of any such order.
