What the department must do before assessing a non-filer to best judgment

Circular No. 129/48/2019-GST dated 24 December 2019 · 2019-12-24

CBIC prescribed a uniform procedure for non-filers. A system-generated reminder goes out three days before the due date, followed by a notice in FORM GSTR-3A after the due date giving fifteen days to file. If the return is still not filed, the officer may assess the liability to the best of his judgment under section 62 and issue an order in FORM GST ASMT-13. That order is deemed withdrawn if the taxpayer files the valid return within thirty days of service.

Practical effect: An ASMT-13 best-judgment order is not the end; filing the missing return within the statutory window from service makes it fall away automatically.

Reverse charge on renting commercial property from unregistered landlords

Notification No. 09/2024-Central Tax (Rate) · 2024-10-08

With effect from 10 October 2024, renting of any immovable property other than residential dwellings by an unregistered person to a registered person was brought under the reverse charge mechanism. The registered tenant must self-invoice and pay 18 per cent GST on the rent, with credit available subject to the usual conditions. The change plugged revenue leakage from unregistered landlords of shops, godowns and offices, and was later clarified to exclude composition-scheme tenants.

Practical effect: Registered businesses renting shops or godowns from unregistered landlords must pay GST on the rent under reverse charge every month and claim the credit where eligible.

GSTN launched the Invoice Management System (IMS) on the portal from 14 October 2024. Buyers can now view each invoice uploaded by suppliers in GSTR-1, IFF or GSTR-1A and mark it as accepted, rejected or pending. These actions determine what flows into GSTR-2B, with the first IMS-based GSTR-2B generated on 14 November 2024 for the October 2024 period. Records left without action are treated as deemed accepted.

Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.

What is GSTR-2B and why does my consultant match it before filing?
GSTR-2B is an auto-drafted statement of the input tax credit available to you, generated on the 14th of every month from the GSTR-1 and IFF filings of your suppliers. Input tax credit in GSTR-3B can only be claimed for invoices appearing in GSTR-2B, so matching your purchase register against it before filing is essential. If a supplier has not uploaded an invoice, the credit must be deferred and the supplier followed up. How is interest calculated if I pay GST late?

Exempt supplies for Rules 42 and 43 include nil-rated and wholly exempted supplies, and by virtue of Section 17(3) also cover outward supplies on which your recipient pays tax under reverse charge, transactions in securities valued at one percent of sale value, and sale of land or completed buildings valued at stamp duty value. Importantly, interest earned on deposits, loans or advances is excluded from the exempt turnover for this computation for everyone except banking companies and financial institutions.
