The taxpayer filed GSTR-3B late and paid interest only on the net cash portion of the tax. The High Court held that on the language of Section 50 as it then stood, interest ran on the gross liability, because input tax credit is credited to the ledger only when the return is filed. The decision caused wide concern in trade, and Parliament later amended Section 50 with retrospective effect from 1 July 2017 to charge interest only on the cash component in most late-return cases.

What it means for you: For late returns, interest is now generally computed on the cash portion only — if an older notice demands interest on gross tax, rely on the retrospective proviso to Section 50.

Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My landlord in Chitlapakkam has no GSTIN but my business is registered. Who pays GST on the shop rent?
You do. With effect from 10 October 2024, renting of immovable property other than a residential dwelling by an unregistered person to a registered person was brought under reverse charge through Notification 09/2024-Central Tax (Rate). What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Larger cars, SUVs above these specifications, attract the 40 percent rate, but with the compensation cess gone, the overall burden on most of them is still lower than before. Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Chitlapakkam architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. For hotels, the state where the hotel stands is always the place of supply, which is why accommodation is invariably billed with that state's local taxes regardless of where the guest's business is registered.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses.
