The 51st meeting recommended amendments to the CGST Act and IGST Act, including Schedule III, to tax supplies in casinos, horse racing and online gaming at 28 per cent. Valuation was fixed at the amount paid or payable to or deposited with the supplier by or on behalf of the player, excluding amounts staked out of winnings of previous games or bets, so the tax applies on entry deposits rather than on every bet. Suppliers of online money gaming located outside India were required to take a single simplified registration, failing which public access to their platforms can be blocked. The Council said the process of amending the Acts would be completed within two months, and the amendments were brought into force from 1 October 2023.
Practical effect: From 1 October 2023, gaming operators must pay 28 per cent on user deposits, and foreign platforms without Indian registration face blocking and enforcement.

Electrically operated vehicles including two-wheelers and three-wheelers, fuel cell and hydrogen vehicles, e-bicycles and chargers or charging stations for electric vehicles remain in Schedule I at five per cent. Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.
What to do about it: The tax gap between an electric two-wheeler at five per cent and a petrol motorcycle at eighteen per cent is now the single biggest pricing lever for Chennai vehicle dealers.

GSTN rolled out biometric-based Aadhaar authentication and document verification for GST registration applicants in Tamil Nadu and Himachal Pradesh. Applications identified by data analytics and risk parameters are routed for biometric verification, requiring the applicant to book a slot and visit a GST Suvidha Kendra with original documents for photograph and fingerprint capture. Rule 8 of the CGST Rules was amended to support this risk-based process.
What to do about it: New applicants in Chennai should keep originals ready and complete the GSK biometric visit promptly, as registration is not granted until verification is done.
