The Supreme Court examined contracts for supplying cranes, tankers and vehicles to ONGC. It held that a transfer of the right to use goods requires the customer to obtain effective control and legal right to use the goods to the exclusion of the owner. Where the owner retains the operator, control and responsibility, the arrangement is a service contract and not a deemed sale. Sales tax or VAT was therefore not attracted; service tax was.
What it means for you: Chennai transport, crane and equipment hire businesses should draft contracts carefully, since who controls the asset decides whether GST applies as a supply of service or of goods.

CBIC clarified that serving food in schools under the mid-day meal programme is exempt from GST, and that the exemption extends to pre-schools and anganwadis, which are covered within the meaning of an educational institution providing pre-school education. It further clarified that the exemption applies whether the meals are funded by government grants or by corporate donations, since the entry does not distinguish by source of funding. The clarification protected non-profit caterers running school feeding programmes from demands.
Practical effect: Chennai caterers running school or anganwadi meal contracts are exempt, but should keep the scheme documentation on file to answer any scrutiny.

CBIC waived late fee in excess of Rs 500 per return (CGST plus SGST) for composition taxpayers who had not filed GSTR-4 for the quarters from July 2017 to March 2019 or for the financial years 2019-20 to 2021-22, and waived it fully where the return was a nil return. The concession applied to returns filed between 1 April 2023 and 30 June 2023, a window later extended to 31 August 2023.
What to do about it: Composition dealers with old unfiled GSTR-4s could clear the entire backlog for a nominal cost, so pending-return notices from this period should cite this amnesty.
