States retain legislative competence to impose taxes on mineral rights and on mineral-bearing land, and this power is not taken away by the central mining legislation. A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Following the Supreme Court directions in Union of India versus Filco Trade Centre, the Board issued guidelines allowing every aggrieved taxpayer to file or revise FORM GST TRAN-1 and TRAN-2 on the common portal during a special window from 1 October 2022 to 30 November 2022. The circular set out the declaration to be filed, the requirement to submit a self-certified copy to the jurisdictional officer, and the verification timelines that follow the filing.
