CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.

An assessment order for 2019-20 alleged wrongful availment of input tax credit, and the taxpayer's rectification petition, which annexed a detailed reconciliation between GSTR-2A and GSTR-3B, was simply left undecided by the department. The Madras High Court recorded that the reconciliation had been furnished and directed the officer to consider and dispose of the rectification petition dated 12 March 2024 by a speaking order, after affording a reasonable opportunity to the taxpayer, within one month.

Practical effect: If you have filed a rectification application with a proper 2A versus 3B reconciliation and heard nothing, the department can be compelled to pass a reasoned order.

Hotel room GST restructured on transaction value and outdoor catering cut to 5 per cent

37th GST Council Meeting, Goa — 20 September 2019 · 2019-09-20

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

What to do about it: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?

Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order.
