The Council recommended nil GST on food preparation of millet flour in powder form containing at least 70 per cent millets by weight when sold loose, and 5 per cent when pre-packaged and labelled. GST on molasses was slashed from 28 per cent to 5 per cent to benefit sugarcane farmers and reduce cattle feed costs. The Council also clarified that job work services of converting barley into malt attract the concessional 5 per cent rate applicable to job work in relation to food products, and not 18 per cent.

The Maharashtra appellate authority held that penal interest and cheque bounce charges collected by a finance company from borrowers who delayed instalments are consideration for tolerating an act and are liable to GST at 18 per cent. CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.
Why this matters: If you collect late payment penalties from customers, check whether the charge sits inside the main contract before deciding to levy GST on it.

The department issued consolidated show cause notices covering 2017-18 to 2022-23. The Madras High Court held that clubbing more than one financial year in a single notice is impermissible and that notices must be issued separately for each tax period, and disposed of two of the petitions accordingly. The third petition, which challenged an ASMT-10 scrutiny notice on GSTR-1 versus GSTR-3B differences, was dismissed with liberty to reply within four weeks.
