Schedule III carries twenty per cent central tax, that is forty per cent combined, and is deliberately short. It covers aerated waters and other beverages containing added sugar or sweetening matter, caffeinated beverages, carbonated beverages of fruit drink, larger motor cars and hybrids above the small-car limits, motorcycles above 350 cc, aircraft for personal use, yachts and pleasure vessels, revolvers and pistols, smoking pipes and cigarette holders, and specified actionable claims such as betting, casinos, lottery and online money gaming.
Why this matters: Only a narrow list attracts forty per cent, so a supplier pushed into that slab by an officer should check whether the goods actually appear in Schedule III.
50th GST Council Meeting, New Delhi — 11 July 2023 · 2023-07-11
The 50th GST Council meeting decided that online gaming, casinos and horse racing would be taxed at 28 per cent on the full face value of bets or chips purchased, without distinguishing games of skill from games of chance. The Council recommended amending the GST laws to include online gaming and horse racing as taxable actionable claims. The decision reshaped the economics of the online real-money gaming industry and triggered large retrospective demand notices on gaming companies.
Practical effect: Any Chennai business operating or facilitating real-money games must register, charge 28 per cent on deposits and expect close departmental scrutiny of past periods.
Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
