Rule 59(6), CGST Rules, 2017, inserted by Notification No. 94/2020-Central Tax · 2020-12-22
Rule 59(6) was inserted so that a monthly filer who has not furnished GSTR-3B for the preceding two months cannot file GSTR-1, and a quarterly filer who has not furnished the return for the preceding tax period cannot file GSTR-1 or use the invoice furnishing facility. A person restricted under Rule 86B who has not filed the immediately preceding GSTR-3B is likewise blocked. The restriction was actually switched on at the portal from 1 September 2021, and Notification No. 35/2021-Central Tax later reduced the trigger from two preceding months to the immediately preceding month with effect from 1 January 2022. The same notification also lengthened e-way bill validity computation to two hundred kilometres a day and extended registration processing where physical verification is ordered.
What to do about it: One missed GSTR-3B in a Chennai business now stops the outward statement as well, which in turn stops the customers' credit and quickly escalates into commercial pressure.

Table 3.1.1 was added to GSTR-3B so that supplies notified under Section 9(5), such as passenger transport, restaurant service supplied through an app, hotel accommodation and housekeeping, are reported separately. The e-commerce operator reports the value and pays the tax in row (i), while the underlying supplier reports the same value in row (ii) and pays nothing on it, so the turnover is not counted twice across the two returns.
How we apply it: Chennai restaurants and cab operators supplying through an app must still report those sales in Table 3.1.1(ii) even though the platform pays the tax.

The Board answered a set of service taxability questions arising from the 52nd GST Council meeting. Among them, it confirmed that District Mineral Foundation Trusts set up by State Governments qualify as Governmental Authorities and are therefore eligible for the exemptions available to such authorities. Other classification and exemption questions on specified services were also settled, so that field formations across States adopt a uniform view rather than issuing conflicting demands.
Practical effect: Contractors in Tamil Nadu working for statutory trusts and authorities should verify the exemption position against this circular before quoting a GST-inclusive price.
