The notification has been challenged in several High Courts on the ground that it was issued without a prior GST Council recommendation and without any subsisting force majeure, and the validity question is presently before the Supreme Court, with many demand orders kept alive subject to the outcome.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Goods were detained and penalised because Part B of the e-way bill had not been filled in, although the tax invoice and Part A carried all the required details and there was no dispute about the goods or their value. The High Court held that non-filling of Part B, without any material showing an intention to evade tax, is a technical breach that does not attract penalty under Section 129. The penalty was set aside and refund of the deposit directed.
What to do about it: For a Part B omission with correct invoices, argue absence of intent to evade — the Section 129 penalty is usually not sustainable on those facts.
