From 15 November 2017 the rate became 5 per cent with the express condition that no input tax credit on goods and services used in supplying the service may be taken. No claim bonus in insurance and entity-wise exemption from e-invoicing

The Board clarified two unrelated points. A no claim bonus allowed by an insurer is a permissible discount under Section 15(3)(a) and may be deducted from the value of the insurance service, provided it is shown in the invoice. Separately, where an entity is exempt from the requirement to issue e-invoices, that exemption attaches to the entity as a whole and covers all its supplies, including supplies unrelated to the activity that gave rise to the exemption.

A vehicle carrying laboratory equipment was seized because the consignee address on the invoice did not match the address on the GST registration, and a demand of Rs. 12,46,678 was raised. The Madras High Court allowed the writ petition, finding no attempt to evade tax: the supplier had issued a proper tax invoice and e-way bill, tax compliance during transportation was established, and the address in question was subsequently added to the registration.

Practical effect: Keep your additional places of business updated on the registration, but if a consignment is detained on this ground the penalty can be resisted where no evasion is shown.

My transporter has no GST number. How does the e-way bill work then?
Transporters who are not registered under GST must still enrol on the e-way bill portal, which issues them a fifteen-digit Transporter ID, commonly called a TRANSIN, generated from their PAN and state. You quote this ID in Part A so the transporter can later update vehicle details in Part B, including changes when goods are shifted to another vehicle en route. How does the Section 129 penalty differ if the owner of the goods does not come forward?
The statute draws a sharp line. Where the owner of taxable goods comes forward, the release penalty is 200 percent of the tax payable. Where the owner does not come forward, the penalty jumps to 50 percent of the value of the goods or 200 percent of the tax, whichever is higher, which is usually far costlier. For exempted goods the figures are 2 percent of value or Rs.25,000 whichever is less when the owner appears, and 5 percent of value or Rs.25,000 otherwise. Ownership is normally established through the invoice; consignors in Egattur should therefore claim the goods promptly rather than staying silent.
What is confiscation under Section 130 and how is it different from detention?
Detention under Section 129 is temporary custody pending a penalty for a transit contravention. Under the proviso to Rule 138E, you can apply to the jurisdictional Commissioner in Form EWB-05, explaining the sufficient cause for which unblocking is sought, such as a genuine financial crisis with a committed payment plan. After giving you a hearing, the officer may permit e-way bill generation for a specified period through an order in Form EWB-06, and the permission can be withdrawn on default. Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable.
