Goods in transit were detained and the trader paid the penalty demanded under Section 129 in order to get the consignment released, while also filing written objections. The department treated the matter as closed. The Supreme Court held that payment made under commercial compulsion is not a voluntary admission, and that where objections are on record the officer must still pass a reasoned speaking order in Form GST MOV-09. Without such an order the statutory right of appeal becomes illusory.
How we apply it: If a Chennai trader or transporter pays an e-way bill penalty only to release detained goods, record a written protest and objection at once and insist on a speaking order so that the appeal route stays open.
49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18
The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
What to do about it: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.
Notification No. 10/2017-Central Tax dated 28.06.2017 · 2017-06-28
This notification amended the CGST Rules, 2017 as originally notified under Notification 03/2017-Central Tax, adding the substantive operating chapters that had been left out of the first tranche.
