A five-judge Bench held that an exemption notification must be interpreted strictly, and the burden of proving entitlement lies on the person claiming it. If there is genuine ambiguity in the wording of an exemption, the benefit of doubt goes to the revenue, not the taxpayer. This overruled the contrary view in Sun Export. GSTN and NIC advised that multi-factor authentication using OTP over registered mobile, Sandes app or similar becomes mandatory for the e-way bill and e-invoice portals in phases: from 1 January 2025 for taxpayers with turnover above Rs 20 crore, from 1 February 2025 above Rs 5 crore, and from 1 April 2025 for all users. Businesses were told to update registered mobile numbers and activate MFA for all sub-users in advance.
What it means for you: Register current mobile numbers for every e-way bill sub-user and enable MFA before dispatch operations get locked out.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
