A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Practical effect: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Detention under Section 129 is temporary custody pending a penalty for a transit contravention. Confiscation under Section 130 is the graver step where the department alleges intent to evade tax, for instance supplying unaccounted goods, or using a conveyance for carrying goods in contravention with the owner's knowledge. Confiscated goods vest in the government, but the owner is given an option to pay a fine in lieu of confiscation up to the market value of the goods less the tax, in addition to tax and penalty. The conveyance owner can similarly redeem the vehicle by paying a fine equal to the tax payable on the goods carried.
Can the transporter get the truck released even if the penalty on the goods is unpaid?
Yes. Section 129(6) permits release of the conveyance alone on payment by the transporter of the penalty determined or Rs.1 lakh, whichever is less, so a lorry owner is not held hostage to a consignor's dispute. On the goods themselves, if the penalty is not paid within fifteen days of the MOV-09 order, the department can sell or dispose of the detained goods to recover the amount, and perishable or hazardous goods can be sold even earlier.
