Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
How we apply it: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.
NIC Advisory, January 2024 — minimum six-digit HSN code in e-way bills from 1 February 2024 · 2024-02-01
From 1 February 2024, taxpayers with annual aggregate turnover above Rs 5 crore must give at least a six-digit HSN code for goods in Part-A of the e-way bill, while taxpayers below that turnover must give at least four digits. The system validates the code against the HSN master maintained on the portal, so an incomplete or invalid code prevents generation of the e-way bill and holds up the dispatch of goods.
Why this matters: Clean the HSN master in your billing software to six digits, because a single wrong code can stop a lorry at the loading bay.
Notification No. 15/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18
This notification removed the words governmental authority and government entity from the concessional works contract entries in the services rate notification. With effect from 1 January 2022, works contract services supplied to a governmental authority or a government entity ceased to enjoy the 12 per cent rate and moved to 18 per cent with input tax credit. Only supplies made directly to the Central Government, a State Government, a Union territory or a local authority continued at the concessional rate at that stage.
Practical effect: Chennai contractors working for boards, corporations and government companies moved to 18 per cent from 1 January 2022, and should have raised price-variation claims for contracts signed earlier.
