Tvl. Skanthaguru Innovations (P) Ltd v. Commercial Tax Officer — Madras High Court, W.P. No. 29872 of 2024, decided 28 November 2024 (Krishnan Ramasamy J.) · 2024-11-28
The taxpayer argued that Rule 86A permits blocking only of credit actually available in the ledger, so a negative block was without jurisdiction. Departing from the Gujarat and Delhi High Court view, the Madras High Court adopted a purposive reading and held that 'available' means credit that was available at any point of time for debit, so negative blocking is permissible. It also held that Central and State authorities may act independently for different periods and amounts. The petition was dismissed.
What to do about it: Chennai taxpayers cannot resist a Rule 86A block merely because the ledger balance is nil; the answer lies in producing supplier documents and seeking unblocking on merits.
GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.

In an ex-works contract, title and risk pass at the supplier's factory gate when goods are handed over to the carrier arranged by the buyer, even though physical delivery to the buyer happens later. CBIC clarified that the condition of receipt of goods in Section 16(2)(b) is satisfied at that point through the deemed-receipt provision, so the buyer may claim input tax credit in that period, subject to actual receipt, use in business and the other conditions of Section 16.
Why this matters: Buyers on ex-works terms, common in the automobile supply chain, need not defer credit to the month of physical arrival at their premises.
