An exporter's refund of IGST paid on exported goods was withheld on the ground that it had claimed duty drawback at the higher rate. Following the Gujarat High Court's Amit Cotton Industries ruling, the Madras High Court held that claiming drawback does not disentitle the exporter to refund of IGST paid on exports, and directed the customs authorities to process the refund along with applicable interest, since the circular relied upon by the department could not override the statutory refund right.
Practical effect: Exporters from Chennai whose IGST refunds are stuck over drawback objections should press this jurisdictional precedent for release of refunds with interest.

This notification amended the CGST Rules, 2017 to insert rules 138 to 138D, creating the legal framework for the electronic way bill covering generation of Part A and Part B details, the validity period based on distance, cancellation, acceptance or rejection by the recipient, verification of documents and conveyances in transit, and reporting of detention exceeding thirty minutes. The rules were notified first and made operative later.
What to do about it: Chennai transporters and consignors should know that the e-way bill obligation is a rule-based obligation under rules 138 to 138D, which is why it can be amended without amending the CGST Act.
Circular No. 17/17/2017-GST dated 15 November 2017 · 2017-11-15
Because the refund module was not available on the common portal, CBIC directed that refund claims relating to zero-rated supplies be filed and processed manually. The applicant generated FORM GST RFD-01A online, printed it and submitted it with supporting documents to the jurisdictional office, which issued acknowledgement in RFD-02, a deficiency memo where needed in RFD-03, the provisional refund order in RFD-04 and the final sanction or rejection order in RFD-06. It also set out the documents and statements required for exports of goods and of services.
Practical effect: Refund claims for the early GST periods were processed under this manual route, so old files and any pending litigation from 2017-18 must be read against this circular rather than the present online process.
