There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. My supplier issued a credit note against an earlier invoice. What must I do with the ITC?
When a supplier issues a credit note reducing the taxable value or tax, you must correspondingly reverse the proportionate ITC you had claimed on the original invoice, since the supplier's output liability reduces only when your credit reduces. The credit note flows into your GSTR-2B as a negative entry, and your GSTR-3B claim should net it off in the same period. With the Invoice Management System introduced on the portal from October 2024, you can accept, reject or keep pending supplier documents, and your action on a credit note directly shapes your GSTR-2B. Reconcile purchase returns, rate differences and discount credit notes monthly so reversals never lag behind.
Is there a late fee if I delay the monthly PMT-06 payment under QRMP?
No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. Late fee does apply if the quarterly GSTR-1 or GSTR-3B itself is filed late.
Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act.
