The Court examined whether canned or branded software sold on floppies and discs could be taxed as goods under sales tax law. It held that the term goods covers all types of movable property, tangible or intangible, provided the item can be abstracted, transmitted, transferred, delivered, stored and possessed. The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

This notification prescribed the number of digits of the Harmonised System of Nomenclature code to be shown on a tax invoice, keyed to the turnover in the preceding financial year. Businesses up to Rs 1.5 crore were not required to show any HSN code, those between Rs 1.5 crore and Rs 5 crore had to show two digits, and those above Rs 5 crore had to show four digits. The requirements were tightened in later years.
