The GST Appellate Tribunal's e-filing portal at efiling.gstat.gov.in became operational on 24 September 2025, finally giving taxpayers a forum for second appeals against orders of appellate and revisional authorities. Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.

Notification No. 21/2021-Central Tax (Rate), dated 31 December 2021 · 2021-12-31

On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.

What it means for you: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.

What is the time limit for filing a GST appeal against an order?
An appeal to the appellate authority must be filed in Form APL-01 within three months from the date the order is communicated to you. The appellate authority can condone a delay of up to one further month if you show sufficient cause, but has no power to admit an appeal beyond that. The clock runs from communication of the order, which is usually the date it is served on the portal. Diarise the deadline the day you receive any adverse order, because gathering documents, computing the pre-deposit and drafting grounds takes time. If I lose the first appeal, what does it cost to go to the GST Appellate Tribunal?
An appeal to the GST Appellate Tribunal requires payment of the admitted dues in full plus an additional pre-deposit of 10 percent of the disputed tax, over and above the 10 percent already paid at the first appeal stage. Following the Finance (No. 2) Act 2024 amendments effective 1 November 2024, this additional deposit was reduced from the earlier 20 percent, and is capped at Rs.20 crore each under CGST and SGST. On payment, recovery of the balance demand stays until the Tribunal decides. With the Tribunal benches now being operationalised, orders in limbo for years can finally be tested; keep certified copies of every order ready.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. Without this mapping, recovery notices can continue despite full payment, so businesses in Kovilambakkam with paid-but-open demands should file DRC-03A promptly.
Do I need to file all old returns before applying for revocation?

Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Why is there GST on an under-construction flat but not on a ready-to-move one?

After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends.
