37th GST Council Meeting, Goa — 20 September 2019 · 2019-09-20

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

CBIC again invoked Section 168A to extend the time for passing orders under Section 73(10) to 30 April 2024 for FY 2018-19 and 31 August 2024 for FY 2019-20. The notification has been challenged in several High Courts on the ground that it was issued without a prior GST Council recommendation and without any subsisting force majeure, and the validity question is presently before the Supreme Court, with many demand orders kept alive subject to the outcome.

If the cancellation was initiated by the department, for example for non-filing, the primary remedy is a revocation application in Form REG-21 within ninety days of the cancellation order, after filing all pending returns and clearing tax, interest and late fees. Revocation is quicker and handled by the same jurisdictional officer. An appeal in APL-01 within three months is the route when revocation is rejected, when the ninety-day window is lost, or when you dispute the very grounds of cancellation. What penalties does Section 122 of the CGST Act prescribe, and for which offences?

The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. My footwear shop sells chappals at Rs.300 and shoes at Rs.4,000 on the same bill. How do I invoice this?
One invoice can comfortably carry both rates. Each pair is tested against the Rs.2,500 sale-value threshold independently, so the chappals are billed at 5% and the Rs.4,000 shoes at 18%, as separate line items under their footwear HSN codes in Chapter 64. Your GSTR-1 HSN summary will then show turnover split across the two rates. Ensure the billing software picks the rate from the item price automatically rather than from a fixed product master, because the same article sold at different price points can legitimately fall in different slabs. What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty.
