The taxpayer paid the ten per cent appeal pre-deposit by debiting its electronic credit ledger. The Orissa High Court upheld the rejection, holding that the pre-deposit under Section 107(6) is not equivalent to output tax and that Section 49(4) restricts use of the credit ledger to payment of output tax. On that reasoning the pre-deposit had to come from the electronic cash ledger. This view conflicts with the later Bombay High Court decision in Oasis Realty.
Why this matters: There are conflicting High Court views on this point — where the amount is significant, paying the pre-deposit in cash avoids the appeal being rejected on a technicality.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
Practical effect: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

The Council approved the draft SGST law and the draft UTGST law, completing the legislative package begun at the previous meeting, and also approved amendments to the GST (Compensation to States) Bill including the ceiling rates at which compensation cess could be imposed. Placing the cess ceilings in the statute meant that later cess increases, such as the one on cigarettes a few months afterwards, could be made by notification without returning to Parliament.
