The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.

Which GST orders can I appeal against?
Any decision or order passed by an adjudicating authority under the GST Acts can be appealed in Form APL-01. Common examples are demand orders under Section 73 or 74 summarised in DRC-07, registration cancellation orders in REG-19, refund rejection orders in RFD-06, best judgment assessment orders in ASMT-13, and penalty orders, including detention cases involving e-way bill lapses. A few matters are excluded, such as orders on transfer of proceedings and seizure directions. Apart from the pre-deposit, is there any court fee for filing a GST first appeal?
No separate court fee or filing fee is charged for an appeal in Form APL-01; the only statutory outflow is the pre-deposit, being the admitted amount in full plus 10 percent of the disputed tax. The law also caps the pre-deposit: with effect from 1 November 2024, the ceiling for a first appeal is Rs.20 crore each under CGST and SGST, reduced from the earlier Rs.25 crore. Detention penalty appeals under Section 129(3) carry their own requirement of 25 percent of the penalty. Can my GST consultant attend a summons hearing on my behalf in Ullagaram?

Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider.
