GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.

Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04
The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

The Supreme Court held that misstatement or suppression of facts must be wilful and coupled with an intent to evade payment of duty before the extended period of limitation can be invoked. An innocent or inadvertent error, even if it results in short payment, does not attract the extended period. The department must establish the mental element, and it cannot be presumed from the mere existence of a short payment.
What to do about it: In a Chennai GST dispute, the burden lies on the department to prove intent to evade before it can go beyond the normal three-year period.
