Circular No. 179/11/2022-GST, dated 3 August 2022 · 2022-08-03

Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.

Navbharat Imports - AAR Tamil Nadu, Advance Ruling No. 35/AAR/2021, dated 30 September 2021 · 2021-09-30

The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

What it means for you: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

Solar and other renewable energy projects are usually supplied as a single turnkey contract covering panels, structures, cabling, erection and commissioning, which led to endless disputes on whether the concessional goods rate or the higher works contract rate applied. From 1 January 2019 the law deemed seventy per cent of the gross consideration to be the value of goods, taxed at the concessional renewable energy rate, and thirty per cent to be the value of the taxable service. The same deeming continues in the current goods rate notification.

The appellate authority can condone a delay of up to one further month if you show sufficient cause, but has no power to admit an appeal beyond that. The clock runs from communication of the order, which is usually the date it is served on the portal. Diarise the deadline the day you receive any adverse order, because gathering documents, computing the pre-deposit and drafting grounds takes time. Apart from the pre-deposit, is there any court fee for filing a GST first appeal?
No separate court fee or filing fee is charged for an appeal in Form APL-01; the only statutory outflow is the pre-deposit, being the admitted amount in full plus 10 percent of the disputed tax. The law also caps the pre-deposit: with effect from 1 November 2024, the ceiling for a first appeal is Rs.20 crore each under CGST and SGST, reduced from the earlier Rs.25 crore. Up to three adjournments may be granted per side. I received Form ADT-01 saying my business is selected for GST audit. What does it mean?
ADT-01 is the intimation that the department will conduct an audit of your records under Section 65. The notice must be issued at least fifteen working days before the audit begins and will specify the financial years covered and the documents required. The audit may happen at your place of business or at the department's office. It is a detailed examination of returns, books, ITC claims and classifications, not a routine visit. Use the fifteen-day window to reconcile your data and organise records rather than waiting for the officers to arrive. I received a GSTR-3A notice for not filing my GST returns. What should I do?

What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
Can you give me a simple GST due-date calendar for my business?
For monthly filers: GSTR-1 by the 11th and GSTR-3B by the 20th of the next month. Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter.
