A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Practical effect: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.

What to do about it: For Chennai agencies, printers and works contractors, the goods and service components of a composite contract should be clearly valued in the agreement and the invoice so that only one tax attaches to each element of value.

After applying for cancellation, do I still have to file GST returns?
Yes, and this trips up many taxpayers. No, as long as your PAN remains the same. The officer approves the amendment, typically within about fifteen working days, and your existing GSTIN continues unchanged with the new name on the certificate. How is GST charged in a joint development agreement between a landowner and builder?
Two supplies run in parallel. The landowner's transfer of development rights is taxable, but the developer pays that tax under reverse charge, and for residential projects the liability is exempt to the extent the apartments are booked before the completion certificate; tax applies on the rights attributable to flats lying unsold on that date, subject to a cap linked to the 1 or 5 percent rate on their value. When a jeweller bills a customer, the metal value and making charges can appear as separate line items with their respective rates on the same tax invoice. Old gold purchased from an unregistered customer in exchange transactions does not attract GST in the customer's hands, but valuation of the net supply must be documented carefully.
