The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.
What to do about it: This is why a Chennai taxpayer is assigned either to the Tamil Nadu Commercial Taxes Department or to CGST Chennai, and why notices come from only one of them for routine matters.

The Madras High Court once again applied the Suguna Cutpiece Center precedent to a taxpayer seeking revival of a GST registration cancelled for default in filing returns after the limitation for revocation had expired. The Court granted restoration on the standard terms — filing of all pending returns, cash payment of outstanding tax with interest and late fee, and departmental verification — confirming that this remedial route remains alive for Tamil Nadu taxpayers years after the original ruling.
What to do about it: The Suguna Cutpiece route is still being applied by the Madras High Court — do not treat a time-barred cancellation as final before exploring a writ remedy.

The Board answered a set of service taxability questions arising from the 52nd GST Council meeting. Among them, it confirmed that District Mineral Foundation Trusts set up by State Governments qualify as Governmental Authorities and are therefore eligible for the exemptions available to such authorities. Other classification and exemption questions on specified services were also settled, so that field formations across States adopt a uniform view rather than issuing conflicting demands.
