The ghee and spices manufacturer ran a Buy n Fly promotional scheme under which retailers meeting sales targets received rewards such as a trip to Dubai, gold vouchers, televisions and air coolers. It claimed input tax credit on those procurements as a business promotion expense. The Authority held that the rewards were handed over without any separate consideration and amounted to gifts, so the credit was blocked by section 17(5)(h), which bars credit on goods disposed of by way of gift or free sample even under a declared marketing scheme.
What to do about it: A Chennai business buying gold vouchers, gadgets or trips for a dealer scheme should budget the GST as a cost rather than as credit.

The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. The dominant nature test was applied to decide the character of the contract.
What to do about it: Chennai businesses with bundled offerings should determine the dominant character of the supply, since that decides classification and rate under GST.

CBIC clarified that transactions in vouchers are neither a supply of goods nor of services. Where a voucher is dealt with on a principal-to-principal basis, no GST arises on its sale or distribution. Where a distributor acts as an agent for a commission, GST applies on that commission. Additional services such as marketing, customisation and technology support are taxable at eighteen per cent, and unredeemed vouchers, or breakage, do not attract GST as no supply takes place.
