CBIC settled a much-litigated question. Remuneration paid to an independent director or any director who is not an employee of the company is taxable in the hands of the company under reverse charge. For a whole-time or executive director, the part declared as salary and on which tax is deducted under section 192 of the Income-tax Act is treated as consideration in the course of employment and is outside GST, while the part treated as professional fees with deduction under section 194J is taxable under reverse charge.

The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.

It argued that this was a transaction with employees in the course of employment and therefore outside GST. The Authority, and the Appellate Authority on appeal, held that GST applies to the car facility extended to employees to the extent the lease cost is recovered from them, since only a perquisite provided without recovery is covered by the employment entry in Schedule III.
