The Chairperson offered a compromise between a fixed 13 per cent growth rate, an average of three of the preceding five years' growth after removing the highest and lowest, and a 14 per cent rate pressed by Kerala and Assam. The Council unanimously agreed that projected State revenue for compensation purposes would grow at a flat 14 per cent per year from the 2015-16 base, with CST in that base counted at the actual 2 per cent. This single number determined the size of the compensation bill for the five-year guarantee period and, when actual GST collections fell short of it, drove the compensation cess extensions and the back-to-back borrowing arrangements of later years.
Practical effect: The 14 per cent guarantee is the reason compensation cess outlived its original five-year sunset, so cess-bearing goods remain costlier than the headline GST rate suggests.
Notification No. 01/2017-Central Tax dated 19.06.2017 · 2017-06-19
This was the first notification issued under the CGST Act. It appointed 22 June 2017 as the date on which the preliminary and registration provisions came into force, including sections 1 to 5, section 10 (composition levy) and sections 22 to 30, which deal with who must register, compulsory registration, the procedure for registration, amendment of registration and cancellation. It opened the GST registration window before the tax itself became payable.
Why this matters: Every Chennai registration granted on or after 22 June 2017 traces its legal authority to this notification, so registration certificates dated from that day are validly issued.
Columbia Asia Hospitals Pvt Ltd — AAAR Karnataka, Order No. KAR/AAAR/05/2018-19, dated 12 December 2018 · 2018-12-12
The Karnataka AAR, affirmed by the AAAR, held that activities of a company's head office, including accounting, administration and IT carried out by its employees, constitute supplies to its branch registrations in other states, since each registration is a distinct person under GST. This made cross-charging of head office costs, including employee cost, a taxable event. CBIC Circular No. 199/11/2023-GST dated 17 July 2023 later eased the position where full input tax credit is available to the recipient branch.
What to do about it: Multi-state businesses headquartered in Chennai should implement a documented cross-charge or ISD mechanism for head office costs.
