34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
How we apply it: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.
Tata Motors Ltd — AAR Gujarat, Advance Ruling No. GUJ/GAAR/R/39/2021, dated 30 July 2021 · 2021-07-30
The Gujarat AAR held that the nominal amount Tata Motors collects from employees for canteen food, which it passes on to the canteen contractor without any profit, is not consideration for a supply and does not attract GST. However, it also held that input tax credit on the GST charged by the canteen service provider is blocked credit under Section 17(5)(b)(i) of the CGST Act and cannot be claimed by the employer, even though the canteen is maintained to comply with the Factories Act, 1948.
What to do about it: Even where employee canteen recoveries escape GST, do not claim ITC on caterer invoices without checking the Section 17(5) blocked-credit conditions.

Following the Supreme Court directions in Union of India versus Filco Trade Centre, the Board issued guidelines allowing every aggrieved taxpayer to file or revise FORM GST TRAN-1 and TRAN-2 on the common portal during a special window from 1 October 2022 to 30 November 2022. The circular set out the declaration to be filed, the requirement to submit a self-certified copy to the jurisdictional officer, and the verification timelines that follow the filing.
Why this matters: Transitional credit disputes from 2017 that reached the courts were routed through this one-time window, and any pending verification of a Chennai taxpayer's TRAN filing is governed by these guidelines.
