It held that a transfer of the right to use goods requires the customer to obtain effective control and legal right to use the goods to the exclusion of the owner. Where the owner retains the operator, control and responsibility, the arrangement is a service contract and not a deemed sale. Sales tax or VAT was therefore not attracted; service tax was.

What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information.
