Notification No. 1/2017-Central Tax (Rate), dated 28 June 2017 (G.S.R. 673(E)) · 2017-06-28

Munjaal Manishbhai Bhatt v. Union of India — Gujarat High Court, 2022 · 2022-05-06

In a bungalow purchase where land constituted the dominant value, the Gujarat High Court held that the deeming fiction treating land value as one-third of the total consideration for GST on construction is arbitrary if applied mandatorily. Where the actual value of land is ascertainable from the agreement, tax must be computed after deducting the real land value; the one-third deduction in the rate notification was read down as optional, available at the taxpayer's choice.

If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry. I received an intimation in DRC-01C about ITC mismatch. How do I respond?
DRC-01C is issued under Rule 88D when the ITC claimed in your GSTR-3B exceeds the ITC available in GSTR-2B beyond the permitted limits. You must respond within seven days, either by paying the excess with interest through DRC-03 or by explaining the difference in Part B of DRC-01C, citing valid reasons such as credits of earlier periods claimed within time, reclaims after Rule 37 payment, or import ITC not flowing through 2B. Until you respond, the portal can block filing of your next GSTR-1. Do not ignore the seven-day window; call +91 - 9600 606 444 the day it arrives.
My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
