Responding to textile traders who store goods in transporters' warehouses, CBIC clarified that the recipient taxpayer may declare the transporter's godown as an additional place of business in his registration. Once that is done, transportation is treated as concluded when the goods reach that godown, the e-way bill need not be extended for the storage period, and the recipient becomes responsible for maintaining accounts of the goods stored there.

A five-judge Bench overruled the earlier view and held that a composite contract for manufacture, supply and installation of a lift is a works contract, because the lift comes into existence as a functional unit only on installation at site. The dominant nature test was rejected for contracts falling within the deemed sale of works contracts. The composite character of such contracts is now the basis of works contract taxation under GST.

The Council recommended nil GST on food preparation of millet flour in powder form containing at least 70 per cent millets by weight when sold loose, and 5 per cent when pre-packaged and labelled. GST on molasses was slashed from 28 per cent to 5 per cent to benefit sugarcane farmers and reduce cattle feed costs. The Council also clarified that job work services of converting barley into malt attract the concessional 5 per cent rate applicable to job work in relation to food products, and not 18 per cent.
Practical effect: Food processors and cattle-feed traders in Tamil Nadu gained significant input cost relief and needed to re-price millet-based products.
