The petitioner challenged a provisional attachment of its bank account. By the time the matter was heard, one year had elapsed from the date of the order. The Court observed that orders of attachment under Section 83 are self-limiting and remain in force for one year only, after which nothing survives for adjudication. The writ petition was accordingly closed, the attachment having ceased to operate by force of the statute itself.
Why this matters: A Chennai business should diarise the date of any Section 83 attachment — after twelve months the bank must release the account, and a fresh order is required if the department wants to continue.
Circular No. 99/18/2019-GST dated 23 April 2019 · 2019-04-23
Following Removal of Difficulty Order No. 05/2019-Central Tax, CBIC clarified that a person whose registration was cancelled on or before 31 March 2019 for non-filing of returns could apply for revocation up to 22 July 2019. Where cancellation took effect from the order date, all returns up to that date had to be filed first. Where it was cancelled retrospectively, returns for the whole period from the effective date of cancellation had to be furnished within thirty days of the revocation order.

Rule 86B, CGST Rules, 2017, inserted by Notification No. 94/2020-Central Tax · 2020-12-22
Rule 86B, effective 1 January 2021, bars a registered person whose taxable turnover in a month exceeds Rs 50 lakh from discharging more than ninety-nine per cent of the output tax liability for that month from the electronic credit ledger. At least one per cent must come from cash. Exemptions apply where the proprietor, managing director or partners have paid more than Rs 1 lakh as income tax in each of the last two years, or where a large refund has been received on exports or an inverted duty structure.
What it means for you: A Chennai business billing above Rs 50 lakh a month cannot run purely on credit and must budget for a minimum cash outgo each month unless it fits an exemption.
