The Council approved the draft SGST law and the draft UTGST law, completing the legislative package begun at the previous meeting, and also approved amendments to the GST (Compensation to States) Bill including the ceiling rates at which compensation cess could be imposed. Placing the cess ceilings in the statute meant that later cess increases, such as the one on cigarettes a few months afterwards, could be made by notification without returning to Parliament.
What to do about it: Tamil Nadu's own SGST Act follows the template approved here, which is why the State and Central provisions a Chennai business faces are near-identical.
M. Trade Links v. Union of India — Kerala High Court, judgment dated 5 July 2024, reported at 2024 KLT OnLine 1624 · 2024-07-05
A large batch of petitions challenged the constitutional validity of Section 16(4), which bars input tax credit claimed after the prescribed deadline, and of Section 16(2)(c). The High Court upheld both provisions, holding that input tax credit is a statutory concession subject to conditions and time limits fixed by the legislature. Limited relief was given for the initial years of GST having regard to the transitional difficulties and the subsequent amendments extending the deadline.
What it means for you: Do not rely on litigation to rescue late credit claims — reconcile and claim within the statutory deadline for each financial year.

The Board answered a set of service classification and exemption questions arising from the 47th GST Council meeting. Most importantly for property transactions, it confirmed that the sale of land after levelling and after laying drainage, water and electricity lines remains a sale of land under Schedule III and is outside GST, while development services such as levelling and laying of drainage lines that the developer itself receives from contractors attract GST at the applicable rate. Several other exemption and rate questions on specified services were also settled.
Practical effect: Chennai plot developers can rely on this circular for the position that a plot sale price is not taxable, but must still bear GST on the development works they buy in from contractors.
